J-FITSIM Terms of Use
Benefit Japan Co., Ltd. (hereinafter referred to as "our company") has established the following terms of use (hereinafter referred to as "these terms") for J-FITSIM for prepaid (hereinafter referred to as "this service") and provides this service to subscribers in accordance with these terms.
- Article 1 (Service)

- The Contractor can use this Service by using a SIM card or eSIM (hereinafter referred to as "SIM") provided by the Company in a terminal device compatible with this Service. This Service can also receive short message service (hereinafter referred to as "SMS").
- The Subscriber can use the Service through the lines provided by Rakuten Mobile Inc. (hereinafter referred to as the "Mobile Phone Carrier") by completing the activation procedures specified by the Company. Details of the Service content are as set forth in the Attachment to these Terms and Conditions, "Other Service Content" (hereinafter referred to as the "Attachment").
- Article 2 (These Terms)

- The Company may change these Terms of Use without obtaining the consent of the Subscriber. In such cases, the terms of use of the Service will be governed by the changed Terms of Use. In such cases, the Company will notify the Subscriber of the changed Terms of Use in an appropriate manner, such as by posting the changed Terms of Use on its website.
- Article 3 (Communication area of this service)

- The communication area for this service is the same as the communication area of the mobile phone carrier (Rakuten Mobile, Inc.). This service can only be used when the connected terminal device is within the communication area. However, even if you are within the communication area, communication may not be possible in places where radio waves are difficult to transmit, such as indoors, underground parking lots, behind buildings, tunnels, mountainous areas, etc.
- If a Subscriber who has agreed to these Terms and Conditions and entered into a service contract for the Service incurs damage as a result of using the Service, the Company shall only be liable for damages that are direct and normally resulting from the use of the Service, and shall not be liable for any other special damages, even if the Company is found to be negligent.
- The number of lines that can be subscribed to for this service is up to 50 per person for J-FITSIM for pripeid. If you wish to subscribe to more than 51 lines, please contact the contact point designated by our company.
- Article 4 (Service Area)

- The service area provided by this service consists of two areas: the Rakuten network area, which uses signals from Rakuten Mobile Inc.'s base stations, and the partner network area (KDDI Corporation, roaming), which uses signals from partner base stations. Please refer to the service area map for details.
https://network.mobile.rakuten.co.jp/area/ - Even within the Rakuten network area, roaming communications may occur using a network provided by a partner network depending on the product settings, signal conditions, etc., such as underground, indoors, or inside a commercial building. Please note that roaming communications will be counted as high-speed data volume for the partner network area. The terms and conditions of the partner network area and roaming (data communication) service area may change without notice.
- The service area provided by this service consists of two areas: the Rakuten network area, which uses signals from Rakuten Mobile Inc.'s base stations, and the partner network area (KDDI Corporation, roaming), which uses signals from partner base stations. Please refer to the service area map for details.
- Article 5 (Establishment and Term of Contract)

- The purchase contract for this product will be concluded when the contractor completes the application process as specified by our company and the product is handed over to the contractor. Please note that the product cannot be returned or exchanged after the purchase contract has been concluded.
- Notwithstanding the provisions of the preceding paragraph, the purchase contract for this product will be concluded when the product is delivered after payment has been made, and the product cannot be returned or exchanged after the purchase contract for this product has been concluded.
- After the contract is concluded, the period for which this service will be provided shall be as set forth in the attached document.
- Article 6 (Terms of Use for the Service)

- The maximum communication speed of the Service is provided on a best-effort basis. Therefore, the actual available communication speed may be reduced depending on factors such as the condition of the communications facilities, the Subscriber's terminal equipment, wiring, interference with other lines, line congestion, and the location of the terminal equipment.
- In addition to the provisions set forth elsewhere in these Terms and Conditions, in order to ensure the quality of the Service and fairness in its use, if a Subscriber's communication volume within a certain period of time exceeds the standards set by our company, the Service may restrict communication use without prior notice to the Subscriber, and the Subscriber agrees to this in advance.
- In order to increase the display speed on the screen of your terminal device, we may carry out optimization of communications as specified separately by us.
- The Contractor may not use the Service using terminal equipment other than that designated by the Company or that conforms to the technical standards prescribed by law.
- The User shall not allow any third party to use the Service, and shall not use the Service for any purpose other than the User's own use.
- Article 7 (Restrictions on Transfer of Rights, etc.)

- The Contractor may not transfer the rights to receive the Service under these Terms and Conditions or the SIM Card.
- The Contractor may not resell the Service or allow a third party to use the Service.
- Article 8 (Changes to Notification Items, etc.)

- If there are any changes in the information the Contractor has notified the Company (such as name, address, billing address, credit card information, telephone number, and email address), the Contractor must promptly notify the Company in accordance with the procedures specified by the Company.
- Even if a Subscriber suffers a disadvantage, such as a notice from the Company not reaching the Subscriber due to the failure to make the notification under the preceding paragraph, the Company shall not be liable in any way, and any notice from the Company shall be deemed to have been received at the time it should normally be received.
- Article 9 (Restrictions on Use)

- The Company may temporarily restrict communications in the event of technical, maintenance, or other unavoidable circumstances arising from the Company's business, or in the event of restrictions on communications by a mobile phone carrier based on the provisions of the contract terms for the telecommunications services provided by the mobile phone carrier or the provisions of a contract concluded between the mobile phone carrier and the Company. In addition, the Service does not guarantee the availability, delay time, or other communication quality of the communications.
- In the case of the preceding paragraph, the User shall not be entitled to claim any damages from the Company for any restriction on communications, except in cases where such restriction is due to the Company's intentional or gross negligence.
- Article 10 (Management of User ID and Password)

- Users who have registered as members of this service (hereinafter referred to as "Registered Users") shall manage their user ID and password for this service at their own responsibility.
- Registered users may not, under any circumstances, transfer or lend their user ID and password to a third party, or share them with a third party. If a user ID matches the registered information and is used to log in, our company will consider that the user ID is being used by the registered user himself/herself.
- If you become aware of any unauthorized use of your User ID by a third party or if you have forgotten your User ID, you must immediately notify us and follow any instructions we give you.
- We shall not be liable for any damages arising from the use of your user ID and password by a third party, except in cases where we are guilty of intentional or gross negligence.
- Contractors and Users who choose to pay by credit card when using the Service shall do so at their own risk, recognizing that there is a risk of information leakage, etc., when transmitting credit card information, etc.
- Article 11 (Restrictions on communication time, etc.)

- In addition to the cases prescribed in the preceding article, when communication traffic is significantly congested, we may restrict communication time or communication use in specific areas.
- In the case of the preceding paragraph, in order to give priority to communications necessary for disaster prevention or relief, for securing transportation, communications or power supplies, or for maintaining order in the event of or in the event of a natural disaster, incident or other emergency, and communications containing urgent matters for the public interest, pursuant to the provisions of the Enforcement Regulations of the Telecommunications Business Act, measures may be taken to suspend the use of communications (including measures to suspend communications to subscriber lines, etc. in specific areas) using mobile radio devices other than those used by institutions designated by the Minister of Internal Affairs and Communications in a public notice (limited to those designated by us, contract carriers or mobile phone carriers in consultation with such institutions).
- If the communication time in a certain period of time exceeds the time specified by our company, or if the communication volume in a certain period of time exceeds the volume specified by our company, we may restrict or disconnect the communication.
- In order to ensure fair usage among Subscribers and to provide the Service smoothly, we may restrict the speed and volume of communications that continuously and heavily occupy bandwidth, such as video playback and file sharing (P2P) applications.
- In the cases of the preceding four paragraphs, the Contractor shall not be entitled to claim any damages from the Company due to restrictions on communication time, etc.
- In order to limit communication time, etc. as stipulated in this Article, we may collect, analyze, and store information related to communications.
- Article 12 (Suspension of provision, termination of contract)

- If a Subscriber falls under any of the following circumstances, we may suspend the provision of the Service or terminate the contract without notice to the Subscriber.
(1) If it is discovered that a false statement was made to the Company when the User commenced use of this Agreement
(2) If there is a violation or risk of a violation of the provisions of these Terms and Conditions
(3) If the User takes any action that places an excessive load on the facilities or lines used in the provision of the Service or that interferes with the operation of such facilities or lines
(4) If it is discovered that the Service is being used using terminal equipment other than that designated by the Company or that conforms to the technical standards prescribed by law.
(5) In addition to the provisions of the preceding paragraph, if the User engages in any act that the Company determines to be significant in terms of technology or in the performance of the Company’s business. 2. The Company shall not be liable for any damage suffered by the User as a result of the suspension of provision of the Service or the termination of the contract under the preceding paragraph.
- If a Subscriber falls under any of the following circumstances, we may suspend the provision of the Service or terminate the contract without notice to the Subscriber.
- Article 13 (Discontinuation of Service)

- We may suspend the provision of the Service without notice to the Subscriber when we carry out maintenance or construction on the facilities or lines used to provide the Service, when a failure occurs in the lines, or in other unavoidable circumstances.
- The Company shall not be liable for any damage suffered by the Subscriber as a result of the suspension of provision of the Service under the preceding paragraph.
- Article 14 (Prohibitions for Contractors)

- The User shall not use the Service to engage in any of the following acts:
(1) Any act that infringes or may infringe the copyrights, trademarks, or other intellectual property rights of the Company or any other person.
(2) Any act that infringes or may infringe on the property, privacy or portrait rights of others
(3) Any act that unfairly discriminates against, libels, or insults others, encourages unfair discrimination against others, or damages their reputation or credibility
(4) Any act that is or is likely to be linked to crimes such as fraud, child prostitution, and illegal buying and selling of savings accounts and mobile phones.
(5) The act of transmitting or displaying images, videos, audio, documents, etc. that are equivalent to obscenity, child pornography, or child abuse, or the act of selling media containing such content, or the act of displaying or transmitting advertisements that evoke the transmission, display, or sale of such content
(6) Any act that is linked or likely to be linked to drug-related crimes or the abuse of controlled substances, advertising unapproved or expired medicines, or selling medicines the sale of which is prohibited over the Internet
(7) Advertising rare wild fauna and flora species that are subject to advertising regulations for the purpose of selling or distributing them
(8) Advertising money lending without being registered to operate a money lending business
(9) Establishing or soliciting for a pyramid scheme
(10) Any illegal alteration or deletion of information stored in the equipment of the Company or the mobile phone carrier
(11) Impersonating another person to use the Service
(12) Transmitting or posting harmful computer programs such as viruses
(13) Sending advertising, promotional or solicitation e-mails to others without permission, or sending e-mails that are socially acceptable or that may cause disgust to others
(14) Any act that interferes with or may interfere with the use or operation of other parties' facilities or Internet connection service facilities
(15) Any act of engaging in illegal gambling, or inducing others to participate in illegal gambling
(16) Contracting, mediating, or inducing (including requesting others to do so) illegal activities (such as the transfer of firearms, the illegal manufacture of explosives, the provision of child pornography, the forgery of official documents, murder, and intimidation)
(17) The act of transmitting to an unspecified number of people any information that is deemed extremely disgusting to others based on social conventions, such as images of murder scenes, images of animals being killed or abused, or other information that is deemed extremely disgusting to others based on social conventions.
(18) Any act of inducing or soliciting another person to commit suicide, or introducing a method of suicide that is likely to cause harm to others
(19) The act of establishing a link in a manner or for the purpose of encouraging any of the acts listed above, while knowing that such acts fall under any of the preceding items.
(20) Any act of encouraging unspecified persons to post, etc., information that is or is likely to be linked to a crime or illegal act, or information that unjustly slanders or insults others, or violates their privacy
(21) Reselling the Service or Products for personal profit
(22) Any other act that the Company determines to be in violation of public order and morals or the rights of others.
- The User shall not use the Service to engage in any of the following acts:
- Article 15 (Limitation of Liability)

- The User shall use the Service at his/her own risk. If the User suffers any damage in relation to the Service, the Company shall not be liable for such damage unless such damage is due to the Company's willful misconduct or gross negligence.
- Article 16 (No Warranty)

- We do not guarantee that the Service or SIM card will be suitable for the Subscriber's intended use, nor do we guarantee communication speeds.
- Article 17 (Changes or Discontinuance of the Service)

- We may change, add to or discontinue all or part of this Service.
- The Company shall not be liable for any damage suffered by a Subscriber as a result of any change, addition or discontinuation of all or part of the Service under the preceding paragraph.
- Article 18 (Representations and warranties against antisocial forces)

- The Subscriber shall represent and guarantee that at the time of entering into and after the conclusion of this Service Agreement, he/she is not a member of an organized crime group, a company or organization related to an organized crime group, or any other anti-social force (collectively referred to as "anti-social forces") and is not under the control or influence of anti-social forces.
- If it is reasonably determined that a Subscriber falls under any of the following items, the Company may terminate the Service Agreement without any notice.
(1) Belonging to an antisocial force
(2) Antisocial forces are substantially involved in the management of the company.
(3) Making use of antisocial forces
(4) Being involved in providing funds or convenience to antisocial forces
(5) Having a socially reprehensible relationship with antisocial forces
(6) Using fraud, violence, or threatening language against a person involved, either by himself or through a third party
- Article 19 (Others)

- If any provision of these Terms and Conditions is determined to be in violation of law, invalid or unenforceable, the other provisions shall remain valid and enforceable.
- Our rights arising from these Terms and Conditions shall not be waived unless we expressly notify the Contractor of such waiver.
- These Terms shall be governed by and construed in accordance with the domestic laws of Japan, and any disputes relating to these Terms or the Service, or any rights and obligations arising from the Service, shall be subject to the exclusive jurisdiction of the Osaka Summary Court or the Osaka District Court as the court of first instance.
- Any cause of action relating to the Service must be brought within one year after the cause of action arises.

If your monthly high-speed data usage exceeds the designated volume, your maximum communication speed will be limited to 200kbps until the end of the month. - You can use up to 3GB/month of high-speed data communication until the end of the contract. If you exceed the specified volume, the maximum communication speed will be switched to a slower speed of 200kbps until the end of the month, and will be cancelled on the 1st of each month.
After exceeding the high-speed data usage limit in the partner network area (domestic), communication speeds will be reduced to a slower speed of up to 200 kbps, and will be cancelled on the 1st of each month.
The maximum 3GB includes 1GB each in partner network areas (domestic and international). - You can use up to 7GB/month of high-speed data communication until the end of the contract. If you exceed the specified volume, the maximum communication speed will be switched to a slower speed of 200kbps until the end of the month, and will be cancelled on the 1st of each month.
After exceeding the high-speed data usage limit in the partner network area (domestic), communication speeds will be reduced to a slower speed of up to 200 kbps, and will be cancelled on the 1st of each month.
The maximum 7GB includes 2GB in partner network areas (domestic) and 1.5GB in partner network areas (overseas). - You can use up to 30GB/month of high-speed data communication until the end of the contract. If you exceed the specified volume, the maximum communication speed will be switched to a slower speed of 200kbps until the end of the month, and will be cancelled on the 1st of each month.
After exceeding the high-speed data usage limit in the partner network area (domestic), the communication speed will be switched to a slower speed of up to 200 kbps, and will be cancelled on the 1st of each month.
The maximum 30GB includes 3GB in partner network areas (domestic) and 2GB in partner network areas (overseas).

●You can use the SIM card from the first day of the month following the date of purchase until the end of the month in which your contract period ends, or from the first day of the month following the date on which we ship the SIM card until the end of the month in which your contract period ends.
- Example: If you sign a 12-month plan and purchase on April 15, 2023, the plan will expire at the end of April 2024.
- Example: If you sign up for a 12-month plan and your order is shipped on April 15, 2023, your order will expire at the end of April 2024.
- <Communication speed and other restrictions>
*The maximum communication speed is provided on a best-effort basis. Actual communication speeds may vary depending on location, communication environment, network congestion, and compatible products.
●We may control communication speeds and optimize communications in a way that we deem beneficial in providing fair service (for example, compressing the file sizes of videos played in a browser or app, downloading large files, connecting to other devices, etc., which generate large volumes of communication and may hinder the provision of fair service to other customers).
●If sustained congestion occurs on our network, communications may be restricted.
●Communication is not guaranteed using terminal equipment other than that provided by our company for this service or terminal equipment on which operation has been verified.
●If you use an outdated OS (basic software), the risk of virus infection increases. We recommend that you always update to the latest OS. - About 5G services
●Even if the antenna mark on the screen of your 5G-compatible product displays "5G," it may switch to "4G" and you may be using 4G services.
●To use 5G services, you will need a 5G-compatible device.
